Curfew
Curfew (Section 9.28.010)
In an effort to improve safety and encourage smart choices and behavior for youth, the Cary Police Department is reminding youth and parents about the Village of Cary’s curfew ordinance, which is in effect Sunday through Thursday from 11:00 pm to 6:00 am and Saturday and Sunday from 12:01 am to 6:00 am. The ordinance states that anyone under the age of 17, cannot loiter on or about any street, alley, sidewalk, or public place within the village during these stated hours.
The Village of Cary’s curfew ordinance is about safety, crime prevention, and preservation of the public peace. Youth under 17 who are out past curfew hours are exposed to risks, temptations, and choices that may lead to involvement with the criminal justice system.
The fine for a curfew violation ranges from not less than $50.00 to no more than $750.00 for each offense.
Illinois Vehicle Code
The Illinois Vehicle Code also addresses curfew as it relates to the validity of a drivers license. Illinois Compiled Statutes 625ILCS 5/6-107.1(b) states that a license issued to a person under the age of 18 shall not be valid between:

- Exercising First Amendment rights protected by the U.S. Constitution, such as the free exercise of religion, freedom of speech and the right to assembly
- Going to or returning from an official school, religious or recreational activity supervised by an adult and sponsored by a governmental agency, a civic organization or similar entity that takes responsibility for the licensee, without any detour or stop
- Going to or returning home from employment with no detour or stop
- If the minor is accompanied by a parent or guardian
- In a vehicle involved in interstate travel
- Involved in an emergency
- Married or had been married or is an emancipated minor under the Emancipation of Minors Act
- Minor is on an errand at the direction of the parent with no stops or detours
